Do not let this happen to you
This real scenario happened to an Affiliate. Issues like this can and should be avoided. Department of Labor is a powerful entity that can cause financial loss. Be in constant contact with your employees.
- Service Provider A hires Employee B to service customer
- After meeting Employee B at the customer location and doing a quick review of the work schedule, Service Provider A has little to no additional contact with Employee B
- Service Provider A sends regular payments to Employee B
- Employee B decides that they no longer want to service the customer
- Employee B asks Friend to begin servicing the customer. They do not go to the customer to show them the work schedule--rather they simply tell them what to do
- Friend starts servicing the customer
- Friend is not really aware of the customer's expectations and the service to the customer suffers
- Customer is unhappy
- Service Provider A keeps sending checks to Employee B--unaware that Friend is now doing the service
- Employee B keeps the money paid to them by Service Provider A--even though they no longer do the service
- Customer terminates due to poor service
- Friend goes to the Department of Labor to complain that they are not getting paid
- Department of Labor goes to Service Provider to audit their records and find out why they are not paying
- Audits are costly, stressful and time-consuming
